Terms of Service

Welcome to HushName. These terms govern your use of our service. By creating an account or making a purchase, you agree to them. We've written these to be clear and fair — please read them carefully.

1. What HushName Provides

HushName is an AI-powered baby name exploration tool. We use artificial intelligence to generate personalized name suggestions based on your preferences, cultural background, and family context. Our Heirloom Dossiers provide deeper cultural, linguistic, and social analysis of individual names.

2. Important Disclaimers

Not professional advice: HushName is an entertainment and exploration tool — not a professional advisory, linguistic, cultural consulting, legal, or medical service. While we use the term “consultation” to describe our name generation sessions, this does not establish a professional-client relationship of any kind. Our AI-generated suggestions should not be treated as expert cultural, historical, etymological, or linguistic advice.

AI accuracy: Our name suggestions and Heirloom Dossiers are generated by artificial intelligence, which may produce content that is inaccurate, incomplete, misleading, or culturally inappropriate. AI models can and do hallucinate — they may fabricate etymologies, historical associations, cultural meanings, or notable figures associated with a name. You should independently verify any cultural, historical, religious, or linguistic information provided by HushName before relying on it for your naming decision. The final naming decision is always yours and yours alone.

Naming laws: Many jurisdictions have laws or regulations governing permissible baby names. HushName does not provide legal advice and makes no representation that any suggested name is lawful to register in your jurisdiction. It is your sole responsibility to verify that your chosen name complies with the naming laws and registration requirements of your country, state, or territory.

Trademark and intellectual property: Name suggestions may coincidentally match registered trademarks, brand names, or other protected intellectual property. HushName does not conduct trademark searches or IP clearance, and the inclusion of any name in our suggestions does not imply it is free from third-party IP rights. If this matters for your use case, you should conduct your own trademark search.

No medical or health advice: Although HushName is used by expecting parents, nothing in our service constitutes medical, health, pregnancy, or parenting advice. For health-related decisions, consult a qualified healthcare professional.

Service availability: We strive to keep HushName available and reliable, but we do not guarantee uninterrupted, error-free, or continuous access to the service. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by service downtime.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to create an account, use HushName, or make a purchase. By using our service, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

4. Accounts

You are responsible for keeping your password secure and for all activity under your account. One account per person — please don't share credentials or create multiple accounts to circumvent usage limits. You must notify us immediately at support@hushname.com if you become aware of any unauthorised use of your account.

5. Plans and Pricing

HushName offers the following plans:

  • Invitation (Free) — 1 naming consultation (10 curated names), swipe and shortlist, cultural context for every name.
  • Name Discovery ($9.99, one-time) — 1 additional naming consultation, 1 Heirloom Dossier credit. Stackable — purchase as many as you need.
  • Pregnancy Journey ($49.99, one-time) — 100 naming consultations (up to 10 per day), 5 Heirloom Dossier credits, partner linking, unlimited text-to-speech previews, and priority generation.
  • Heirloom Dossier ($4.99 per name) — Available as an add-on after your first consultation. A comprehensive cultural, linguistic, and social profile for any name you love.

All prices are in USD. Prices may be adjusted for purchasing power parity in certain regions, shown at checkout. All purchases are one-time — we do not charge recurring subscriptions. We reserve the right to modify pricing at any time. Price changes will not affect purchases already completed. Current pricing is always displayed on our pricing page and at checkout.

6. Gifting

You may purchase any plan as a gift for someone else. Gifts are delivered by email on your chosen date and include a unique redemption code. Gift codes do not expire. Once redeemed, the gift is non-transferable. Unredeemed gifts may be refunded — contact us for assistance. You are responsible for ensuring that gift purchases are made using legitimate payment methods. HushName is not liable for gifts purchased using stolen or fraudulent payment credentials — such transactions will be reversed by our payment processor.

7. Partner Linking

The Pregnancy Journey plan includes partner linking. When you link accounts, each partner swipes through names independently. A match is revealed only when both partners love the same name. Either partner can unlink at any time. Linking requires both partners to have HushName accounts and for the initiating partner to have an active Pregnancy Journey plan.

Not for legal proceedings: Partner linking data (including match results, swipe history, and linking status) is designed to help families explore names together. It is not intended and should not be relied upon as evidence in any legal proceeding, including but not limited to custody disputes, family court matters, or divorce proceedings. We make no representations about the completeness or accuracy of this data for any purpose beyond casual name exploration.

8. User Content and Input

You are solely responsible for the content you submit to HushName, including all text entered in consultation questionnaires, notes, and preferences. You represent and warrant that your submissions do not contain content that is unlawful, defamatory, obscene, threatening, or that infringes the rights of any third party. We reserve the right to refuse to process any input that violates these terms. We are not responsible for AI-generated output that results from inappropriate, misleading, or harmful user input.

9. Electronic Communications

By creating an account, you consent to receive electronic communications from HushName, including transactional emails (purchase confirmations, partner invitations, gift notifications, and account-related notices). These communications are part of the service and cannot be opted out of while your account is active. We will not send marketing emails without your separate, explicit consent.

10. Refunds

Your first consultation is free — so you can experience HushName before deciding to purchase. Because name consultations and Heirloom Dossiers are generated instantly upon request, we generally cannot offer refunds once content has been delivered.

Australian Consumer Law: Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

European Union residents: Under the EU Consumer Rights Directive, you have a 14-day right of withdrawal for digital content purchases. By proceeding with a purchase and consenting to immediate delivery at checkout, you acknowledge that you waive your right of withdrawal once the digital content has been delivered. If you do not consent to immediate delivery, you retain the right to withdraw within 14 days.

We understand that circumstances vary. If something doesn't feel right, reach out to support@hushname.com and we'll do our best to help. Refunds are always provided where required by law.

11. Acceptable Use

HushName is for personal, non-commercial use. You agree not to:

  • Use automated tools, bots, or scripts to access the service
  • Attempt to circumvent usage limits or security measures
  • Resell, redistribute, or publicly display generated content as your own product or service
  • Use the service to harass, abuse, or harm others
  • Submit content that is unlawful, defamatory, or infringes the rights of others
  • Attempt to reverse-engineer, decompile, or extract source code from the service
  • Use the service to develop a competing product or service
  • Deliberately attempt to produce offensive, harmful, or discriminatory output from the AI system

All plans are subject to rate limits to ensure a smooth experience for everyone.

12. Suspension and Termination

We may suspend or terminate your account if you violate these terms, including the Acceptable Use policy above. Where possible, we will provide notice before taking action, unless immediate suspension is necessary to protect the service or other users.

If your account is terminated for cause, any unused purchased credits (consultations, Heirloom Dossier credits) are forfeited. If we terminate your account without cause, we will refund any unused purchased credits on a pro-rata basis.

You may delete your account at any time from your Settings page. Upon termination or deletion, your licence to use the service ceases immediately. Sections that by their nature should survive termination will continue in effect, including Sections 2 (Disclaimers), 8 (User Content), 11 (Acceptable Use), 13 (IP), 14 (Indemnification), 15 (Limitation of Liability), 16 (Dispute Resolution), 17 (Governing Law), and 18 (General).

13. Intellectual Property

The HushName service — its design, features, source code, algorithms, and original content — is our intellectual property and is protected by copyright, trademark, and other intellectual property laws. The name suggestions and Heirloom Dossiers we generate for you are yours to use personally. You may share them with family and friends, but not resell or republish them commercially. This licence is non-exclusive, non-transferable, and revocable upon termination of your account.

14. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless HushName, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and costs of any legal proceedings) arising from or related to:

  • Your breach of these terms
  • Your misuse of the service
  • Your violation of any applicable law or third-party rights
  • Any content you submit to the service
  • Your use of any name suggested by HushName, including any claims relating to trademark infringement, cultural misrepresentation, or naming law violations
  • Any dispute between you and a linked partner arising from use of the service

This indemnification obligation survives the termination of your account and these terms. This clause does not apply to the extent that a claim arises from HushName's own negligence or wilful misconduct, or to the extent it would be void or unenforceable under the Australian Consumer Law.

15. Limitation of Liability

Warranty disclaimer: To the maximum extent permitted by law, HushName is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that: (a) the service will meet your requirements; (b) the service will be uninterrupted, timely, secure, or error-free; (c) AI-generated content will be accurate, complete, reliable, or culturally appropriate; or (d) any errors in the service will be corrected.

To the maximum extent permitted by law:

  • HushName shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, reputation, or opportunity, however caused and under any theory of liability (including negligence), even if HushName has been advised of the possibility of such damages.
  • HushName shall not be liable for any damages arising from: (a) your reliance on any AI-generated content, including name meanings, cultural information, etymologies, or historical associations; (b) your decision to use, register, or bestow any name suggested by the service; (c) any cultural offence, misrepresentation, or inaccuracy in AI-generated content; (d) any third-party claims relating to names you selected using the service; or (e) any dispute between linked partners.
  • Our total aggregate liability for all claims arising out of or relating to these terms or the service is limited to the greater of (a) the amount you have paid us in the 12 months preceding the claim, or (b) AUD $100.
  • We are not liable for failures or delays caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, internet or telecommunications outages, third-party service failures (including AI providers, payment processors, and hosting services), cyberattacks, government actions, or changes in law (force majeure).

Third-party services: HushName relies on third-party providers (including Stripe for payments, Google and OpenAI for AI generation, Supabase for data storage, and others). We are not liable for any failure, error, data loss, security breach, or other issue caused by these third-party services. Your use of these services is subject to their respective terms and policies.

Australian Consumer Law: If the Australian Consumer Law applies to you, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your account and receive a refund for any unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. For minor failures, you are entitled to have the service re-supplied or to receive a refund. To the extent permitted, our liability for a failure to comply with a consumer guarantee (other than a major failure) is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

16. Dispute Resolution

We hope to resolve any issues informally. If you have a dispute, please contact support@hushname.com first and we'll work to resolve it within 30 days.

If we cannot resolve the dispute informally, either party may refer the matter to mediation administered by the Australian Disputes Centre (ADC) in accordance with its mediation rules. If mediation is unsuccessful within 60 days, either party may commence court proceedings.

Class action waiver: To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. If this waiver is found to be unenforceable in your jurisdiction, this clause shall not apply to you and you retain the right to participate in class proceedings.

Time limit for claims: To the maximum extent permitted by law, any claim or cause of action arising out of or relating to your use of the service or these terms must be filed within one (1) year after such claim or cause of action arose. Claims filed after this period are permanently barred. This limitation does not apply where prohibited by law, including under the Australian Consumer Law.

Nothing in this clause prevents either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.

17. Governing Law

These terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia. If you are accessing HushName from outside Australia, you are responsible for compliance with any applicable local laws, including but not limited to consumer protection laws, data protection laws, and naming regulations.

18. General

Severability: If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All remaining provisions continue in full force and effect.

Assignment: You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations under these terms in connection with a merger, acquisition, reorganisation, or sale of assets, or by operation of law, without your consent. Any attempted assignment in violation of this section is void.

Entire agreement: These terms, together with our Privacy Policy, constitute the entire agreement between you and HushName regarding the service and supersede all prior agreements, representations, and understandings, whether written or oral.

Waiver: Our failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by HushName to be effective.

Headings: Section headings are for convenience only and do not affect the interpretation of these terms.

Relationship: Nothing in these terms creates a partnership, joint venture, employment, or agency relationship between you and HushName.

19. Changes to These Terms

We may update these terms from time to time. When we make material changes, we'll update the date above and notify you by email or by displaying a prominent notice within the service at least 14 days before the changes take effect. If you do not agree to the updated terms, you may close your account before the changes take effect. Continued use of HushName after the updated terms take effect constitutes acceptance.
